1. Who these terms are between
These terms are an agreement between you (the visitor or client) and ZYROMARK PTY, trading as ZyroRent ("we", "us", "our"). By using this website you confirm you've read and agree to these terms, our Privacy Policy, our Cookie Policy, and our Acceptable Use Policy.
2. Information on this website
We work hard to make sure information on this site is accurate, but we do not warrant that it is error-free. Pricing, plan features, turnaround times, and screenshots are indicative until confirmed in your written quote. If anything is unclear, please email us before signing up.
3. Our service
A ZyroRent plan is a monthly rental of a custom-built website. Your monthly fee covers, at a minimum:
- Design and development of the agreed website.
- Professional hosting on our infrastructure.
- SSL certificate, daily/weekly backups, security monitoring and software updates.
- Ongoing content updates and maintenance work, within the time allowance shown on your plan.
- Email support, plus WhatsApp support on the Business and E-Commerce plans.
The exact deliverables, timing and any extras for your project are recorded in your written quote.
4. Pricing & payment
- Prices are in South African Rand (ZAR) and are inclusive of VAT where applicable.
- Your monthly fee is due on the same calendar day each month, by EFT, debit order, or card payment, on a date agreed with you.
- If a payment is not received within 7 days of the due date, we may suspend the website until the account is up to date. We'll always email you before we suspend anything.
- We may change our standard prices in future. Existing clients will be given at least 60 days' written notice before any price increase takes effect, and you may cancel without penalty if you don't accept the increase.
5. Buy-out option
You may, at any time, choose to buy your website outright at the once-off buy-out price shown on your plan (Essential R4,500 / Business R6,500 / E-Commerce R8,500 — confirmed in writing on your invoice). When the buy-out fee is paid in full, we will:
- Hand over the website code, design files and assets to you.
- Assist with a one-time migration to a hosting provider of your choice (additional migration support beyond a reasonable handover may be billed at our standard hourly rate).
- Stop billing you the monthly fee from the next billing cycle.
Until the buy-out fee is paid in full, ZYROMARK PTY remains the owner of the website code, design and assets we created.
6. Cancellation
You may cancel your monthly plan at any time on 30 days' written notice to infozy@zyrorent.co.za. On cancellation:
- Your monthly fee is payable up to the end of the notice period.
- If you do not buy the website out, the website will be taken offline at the end of the notice period and the domain will be released back to you (where you own it) or terminated (where it was registered through us and not transferred).
- You can ask for a copy of any content you supplied (text, photos, your customer database) in a portable format, free of charge.

7. Your responsibilities
To help us deliver a great service, you agree to:
- Provide accurate information when you sign up and keep it up to date.
- Pay your monthly fee on time.
- Respect our Acceptable Use Policy — you are responsible for everything that is published on a website we host on your behalf.
- Not attempt to copy, reverse engineer, resell or sub-licence our code or design files unless you've completed the buy-out.
8. Intellectual property
All website designs, source code, graphics, photographs and other assets created by us remain the intellectual property of ZYROMARK PTY until you complete the buy-out. We grant you a non-exclusive, non-transferable licence to use the website while your plan is active. The ZyroRent and ZYROMARK names, logos and trade dress are our trademarks and may not be used without permission.
9. Service levels & downtime
We aim for 99.9% uptime on Business and E-Commerce plans, and 99.5% on the Essential plan. We are not liable for downtime caused by:
- Scheduled maintenance we've notified you about.
- Failures of upstream providers (your domain registrar, third-party APIs, payment gateways).
- Force majeure events outside our reasonable control (cable cuts, load-shedding affecting an entire region, natural disasters, government action).
10. Limitation of liability
To the maximum extent allowed by law, our total liability to you for any claim arising from your use of this site or our services is limited to the total fees you've paid us in the 6 months immediately preceding the claim. We are not liable for indirect, incidental, special or consequential losses (such as loss of profit or loss of data) except where the law does not permit us to exclude them. Nothing in these terms limits your rights under the Consumer Protection Act.
11. Termination by us
We may suspend or terminate your plan if you breach these terms or our Acceptable Use Policy and don't fix the breach within a reasonable time after we've asked you to. We'll always notify you in writing first, except where the breach is serious enough to require immediate action (e.g. illegal content, security threat).
12. Changes to these terms
We may update these terms from time to time. The version number and date at the top of this page show when they were last changed. If a change affects an existing client, we'll email you and the change will take effect 30 days after we send the email.
13. Governing law & dispute resolution
These terms are governed by the laws of the Republic of South Africa. If we have a dispute, we agree to first try to resolve it directly by email or video call. If we can't, you may approach the National Consumer Commission, the relevant Ombud, or the appropriate South African court.
